What to Do After Forming Your LLC

Forming an LLC is a single filing event. Running one is not. Once the state has accepted your formation document, several practical tasks typically follow — some required, some situational, and none of them automatic just because the LLC now exists.

Get an EIN if your LLC needs one

Many LLCs need an Employer Identification Number for banking, payroll, or federal tax purposes, though not every single-member LLC is required to have one for every purpose. Read What Is an EIN? and Does an LLC Need an EIN?

Decide whether you need a DBA

If the business will operate under a name different from its legal LLC name, that name may need to be registered separately. Read Does an LLC Need a DBA?

Open a business bank account

Keeping business and personal funds separate is a practical step most LLC owners take early, and many banks will ask for the LLC's formation documents and EIN to open an account. Read Business Bank Account for an LLC

Check licenses and permits

Forming an LLC does not itself authorize any regulated activity. Depending on what the business does and where it operates, state, county, city, or federal licenses and permits may apply. Read Does an LLC Need a Business License?

Finish (or start) an operating agreement

Even where not strictly required by state law, documenting how the LLC is governed can be useful from the outset — for single-member and multi-member LLCs alike. Read LLC Operating Agreement

Understand ongoing compliance

Formation is a one-time filing. Most states also expect some form of ongoing maintenance — periodic reports, a current registered agent, and other recurring obligations. Read LLC Compliance

Evaluate business insurance

An LLC does not come with insurance, and forming one does not by itself protect the business from claims, accidents, or losses. Whether coverage makes sense — and what kind — depends on what the business actually does. Read Insurance for a New LLC and Does an LLC Need Insurance?

What doesn't happen automatically when you form an LLC

Forming an LLC does not automatically:

  • • open a business bank account
  • • register a DBA
  • • obtain an EIN
  • • issue any required licenses or permits
  • • put insurance in place
  • • satisfy ongoing state reporting requirements

Each of those is a separate step, and not every step applies to every LLC. This page is a starting point, not a substitute for reviewing your specific state's requirements and your business's actual operations.
