Does an LLC Need a Business License?
Forming an LLC and obtaining a business license are different things.
The LLC filing creates a legal entity under state law. Licenses and permits authorize or regulate particular business activities, locations, professions, products, or services.
Whether your LLC needs a license depends on what it does and where it operates.
LLC formation is not a business license
When a state accepts Articles of Organization, it does not necessarily mean the company is authorized to perform every regulated activity.
A restaurant, contractor, salon, professional practice, retailer, and home-based business can each face very different licensing requirements.
Types of licenses and permits
Requirements can exist at several levels:
State
States may license professions, occupations, industries, sales activities, or regulated products.
County and city
Local governments may require general business registrations, zoning approvals, health permits, signage permits, or activity-specific licenses.
Federal
Certain federally regulated activities can require federal licenses or permits.
How do you find the licenses your LLC needs?
Start with:
- The official state business portal.
- Your county government.
- Your city or municipality.
- The agency regulating your profession or industry.
- Federal agencies if the activity is federally regulated.
The SBA also provides general guidance for identifying licenses and permits, but the actual issuing agency is the authoritative source.
Does an online LLC need licenses?
Possibly.
Operating online does not automatically eliminate licensing, sales-tax, professional, home-occupation, or other requirements. The answer depends on the activity and jurisdictions involved.
Does a home-based LLC need a license?
Possibly.
Local zoning, home-occupation, signage, customer-visit, and industry rules can apply even when the company operates from a residence.
License vs. EIN vs. DBA
These are separate:
- • LLC: legal entity.
- • EIN: federal tax identification number.
- • DBA: alternate business name.
- • License/permit: authorization or regulatory approval for an activity.
A business may need several of them.
Insurance requirements
Some licenses, leases, contracts, or customers may require evidence of particular insurance. That requirement is separate from whether the LLC itself must carry insurance under a general state law.
